Operational Disclosures & Terms of Service

1. OPERATIONAL MANDATE AND NON-ADVISORY STATUS‍ ‍

The Context Terminal operates strictly as a financial publisher and research desk. No intelligence, data extraction, or commentary provided within the Terminal, on this website, or via associated email communications constitutes personalized financial, investment, legal, or tax advice.

The architecture of the Terminal is designed to provide forensic market telemetry for educational and informational purposes only. The algorithms and logical models utilized do not account for, nor do they solicit, your unique financial situation, risk tolerance, time horizon, or liquidity requirements.

By accessing this intelligence, you acknowledge your status as an autonomous practitioner. All execution, capital deployment, and risk management decisions remain your sole responsibility.

2. REGULATORY COMPLIANCE AND CONFLICTS OF INTEREST EU MAR & MiFID II:

EU MAR & MiFID II: In accordance with the EU Market Abuse Regulation (MAR) and Romanian ASF Regulation 5/2018, the logic evaluations and extractions presented constitute generic investment research and objective data synthesis. They do not represent personal investment recommendations.

US SEC Publisher’s Exclusion: The Context Terminal relies upon the "publisher's exclusion" from the definition of an investment adviser under Section 202(a)(11)(D) of the Investment Advisers Act of 1940 and corresponding state securities laws. The Terminal is a bona fide publication of general and regular circulation offering impersonal financial data.

Conflicts of Interest: The publisher and architect of the Context Terminal may, from time to time, hold active positions in the assets, indices, or sectors analyzed within the briefs. The Terminal operates on deterministic logic matrices to eliminate bias, but subscribers must assume that the publisher is actively engaged in the markets discussed.

3. PERFORMANCE METRICS AND HYPOTHETICAL DATA

Any performance track records, model portfolios, or historical logic verifications displayed represent hypothetical results achieved through retrospective application of the Terminal’s architecture.

Hypothetical or simulated performance results have inherent limitations. Unlike an actual performance record, simulated results do not represent actual trading and may not account for the impact of liquidity constraints, slippage, or prevailing market friction. No representation is being made that any practitioner will achieve outcomes similar to those modeled. Past performance is definitively not indicative of future results.

4. LIMITATION OF LIABILITY FOR DATA AND TELEMETRY

The forensic intelligence provided is compiled from sources believed to be reliable. However, the Context Terminal makes no absolute warranties or guarantees regarding the accuracy, completeness, or real-time fidelity of the data.

The Terminal relies on third-party services and APIs for data feeds, calculations, and delivery infrastructure. Discontinuation, latency, or changes to these external services may impact the availability or cadence of the briefs. The publisher assumes no liability for trading losses, capital drawdowns, or damages resulting from errors, omissions, interruptions in service, or third-party outages. The practitioner assumes all execution risk.

5. INTELLECTUAL PROPERTY AND NON-DISTRIBUTION

The Context Terminal, including its underlying code, deterministic layouts, proprietary JSON structures, and written intelligence, is the exclusive intellectual property of the publisher.

Subscription grants the practitioner a single-user, non-transferable license to ingest the HTML deliverable strictly for human-only manual use. You may not allow any AI agent, bot, script, crawler, or automated process to interact with, extract, or ingest the Terminal's outputs. Text and data mining, or utilizing the Terminal’s proprietary assets to train competing models or populate public forums, is a direct violation of these terms. The publisher reserves the right to immediately terminate the subscription without refund and pursue appropriate remedies for intellectual property violations.

6. SUBSCRIPTION MECHANICS AND REFUNDS

Access to the Context Terminal is billed on a recurring basis. Fees are strictly non-refundable, including for unused access or partial subscription periods. Cancellation of the service immediately stops future renewal charges but does not result in a prorated refund for the current billing term.

7. INDEMNIFICATION

By accessing and utilizing the Context Terminal, you agree to hold harmless and indemnify the publisher, its affiliates, and third-party service providers from and against any claims, costs, damages, losses, expenses, and other liabilities arising out of your access to or use of the intelligence, or your violation of these Terms of Service.
